Firm Associate Robert L. Wagner Argues Before United States Court of Appeals for the Federal Circuit.
Nine days after oral argument, the Federal Circuit, in a unanimous per curiam decision, affirmed the trial court's judgment for Midtronics, Inc. in a patent lawsuit originally brought in the United States District Court for the Northern District of Illinois. Robert Wagner argued on behalf of Midtronics before the Federal Circuit on August 8, 2012. Mr. Wagner also served as trial counsel on behalf of Midtronics. The trial court found that defendants willfully infringed Midtronics' patent, enjoined defendants from further infringement, and awarded over $1 million in attorneys' fees.

Microsoft has been ordered to pay $290,000,000 and is enjoined from selling Microsoft Word which contains the infringing XML editor software. Mr. Sneath in commenting on the judge's order for Microsoft to stop selling Word in USA Today said, "Microsoft is behind the eight ball and has 60 days to see if it can get the federal appeals court to stay the injunction." Sneath was recently quoted in the Information Week, EE Times and Computerworld on-line magazines regarding the Trademark Lawsuit filed by Cisco Systems against Apple, Inc over the alleged infringement by Apple of Cisco's iPhone registered Trademark. Sneath noted that the trademark issues were "murky and complicated" and that the stakes were large. For Apple, he said, "a large penalty looms if the court eventually rules against it -- penalties for willfully infringing on a trademark can be tripled, and the court can order payment of full legal fees for the plaintiff, he said.
